These Terms will apply to any contract between us for the sale of Products to you. Please read these Terms carefully and make sure that you understand them, before making any orders. If you refuse to accept these Terms, you will not be able to order any Products from us. These Terms, and any contract between us, are only in the English language.
You should print a copy of these Terms or save them to your computer for future reference.
These terms may be amended from time to time as set out in clause 9 below. Please check these Terms to ensure you understand the rights and obligations that will apply each time you wish to order Products. These Terms were most recently updated on 16 August 2017.
We operate the Co-op Electrical website . We are Co-operatives E-Store Limited, trading as Co-op Electrical, a registered society registered in England and Wales under the Co-operative and Community Benefit Societies Act 2014 with registered number 29166R and with our registered office at 1 Angel Square, Manchester, M60 0AG. Our VAT number is GB403314604. We are part of the Co-operative Group Limited.
If you wish to contact us for any reason, including because you have any complaints, you may call, email and/or write to our customer service team in accordance with our ‘Contact Us’ page. If your complaint is in relation to Products purchased online you can access the Online Dispute Resolution Platform (ODR platform). Further details on the ODR service and access to the ODR platform can be found on their website www.ec.europa.eu/odr.
To cancel a contract in accordance with your legal right to do so please see the information in clause 10 below in relation to the options available to you.
If we need to contact you, or give you notice in writing, we will do so by telephone, email or by pre-paid post to the address you provide to us in your order. If you are emailing us or writing to us please include details of your order to help us to identify it. If you send us your cancellation notice by email or by post, then your cancellation is effective from the date you send us the email or post the letter to us.
You may contact us by telephoning our customer service team by telephone or email as set out on our Contact Us page. If you wish to give us formal notice of any matter in accordance with these Terms, please see clause 1.2(a).s
The images of the Products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products. As a consequence, your Products may vary slightly from those images.
The packaging of the Products may vary from that shown on images on our website.
Our website is provided to you on an "as is" and "as available" basis without any confirmation being given in relation to our website including (but not limited to) implied confirmations of non-infringement, compatibility, security, accuracy or any implied confirmation arising from course of dealing or usage or trade.
We make no confirmation that our website will meet your requirements or will be uninterrupted, timely, or error-free, that defects will be corrected or that the site or the server(s) that makes it available are free of viruses or bugs.
We will not be responsible to you for any loss of material uploaded or transmitted through our website.
If you are a consumer, you may only purchase Products from us if you are at least 18 years old.
If it is found that you are not legally entitled to order certain goods, we reserve the right to cancel your order and will not be obliged to complete the order. We also reserve the right to cancel your account facilities immediately. If we cancel your account or your order, we will immediately refund you any money that you have paid in respect of goods that we will not deliver to you, unless there is any legal reason why this is not possible, e.g. attempted fraud.
If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you purchase Products from us.
These Terms constitute the entire agreement between you and us and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.
You acknowledge that in entering into this contract you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms.
You and we agree that neither of us shall have any claim for innocent or negligent misrepresentation based on any statement in this contract.
When you order on our website, please take the time to read and check your order at each page of the order process. Our website order process allows you to check and amend any errors before submitting your order to us.
Please ensure that you read these terms and conditions before placing any orders with Co-op Electrical. For Products that are marked with a blue van icon, the Product will be delivered within 7 days of placing your order and we will send an email to you so that you can track your order.
After you have provided your payment details, you will be asked to confirm your order. ONCE YOU HAVE PROVIDED PAYMENT DETAILS, DO NOT PROCEED WITH YOUR ORDER IF YOU DO NOT WISH TO BE BOUND TO PAY FOR THE GOODS. PAYMENT WILL BE TAKEN WHEN YOU ORDER.
After you place an order either on the website or over the telephone, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place as described in clause 8.5.
We will confirm our acceptance to you by sending you an e-mail that confirms that the Products have been dispatched (Dispatch Confirmation). The contract between us will only be formed when we send you the Dispatch Confirmation.
If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our website as referred to in clause 14.5, we will inform you of this by e-mail or telephone as soon as possible and we will not process your order. You will then have the option either to wait until the item is available or to cancel your order in accordance with our Cancellation and Returns policies (as set out below). A comparable Product may be substituted in the event of a Product being unavailable, subject to us first obtaining your agreement.
Any Products on the same order, which we have not confirmed in our Dispatch Confirmation e-mail, do not form part of that contract.
For your protection, a contract will not be made if there is any legal reason why this is not possible e.g. attempted fraud, minimum age etc. Also, for your further protection, the information you provide will be subject to identity and fraud prevention checks.
We store the contents of contracts and will send you the details of your order as well as a copy of these Terms via e-mail.
Every time you order Products from us the Terms on our website, being those in force at the time of your order, will apply to the contract between you and us.
We may amend these Terms from time to time for the reasons set out in clause 9.4. Please look at the top of this page to see when these Terms were last updated. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time. Your continued use of our website following any change shall be deemed to be your acceptance of such change. If you do not agree with any change to the Terms you must immediately stop using our website.
If we need to revise these Terms in relation to how they apply to your order, we will contact you as soon as possible to give you advance notice of the changes and give you the option to cancel the order if you are not happy with the changes. You may cancel either in respect of all the Products affected by this changes or just the Products you have yet to receive. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will arrange a full refund of the price you have paid, including any delivery charges.
If you are a consumer, you have a legal right to cancel a contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the period set out below in clause 10.3. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the contract and receive a refund (or an exchange), even if you have opened the goods to inspect them, as long as you have taken reasonable care of the goods. Advice about your legal right to cancel the contract is available from your local Citizens' Advice Bureau or Trading Standards office.
Your legal right to cancel a contract starts from the date of the Dispatch Confirmation (the date on which we e-mail you to confirm our acceptance of your order), which is when the contract between us is formed. Your deadline for cancelling the contract then depends on what you have ordered and how it is delivered, as set out in the table below:

Example: if we provide you with a Dispatch Confirmation on 1 January and you receive the first instalment of your Product or the first of your separate Products on 10 January and the last instalment or last separate Product on 15 January you may cancel in respect of all instalments and any or all of the separate Products at any time between 1 January and the end of the day on 29 January.
To cancel a contract, you just need to let us know that you have decided to cancel and contact our customer services team as set out on our Contact Us page and let us know about your decision to cancel the contract.
If you are writing to us (whether by email or post) please include details of your order (including the order reference) to help us to identify it. If you send us your cancellation notice by email or by post, then your cancellation is effective from the date you send us the email or post the letter to us. For example, your notice to cancel will be within the deadline if you have put your letter into the last post on the last day of the cancellation period or email us before midnight on that day (see timescales in clause 10.3 above).

We will refund you using the same method of payment that you used to place your order.
If a Product has already been despatched to you before you decide to cancel your contract then the Product must be made available for collection by us without undue delay and in any event not later than 14 days after the day on which you give us notice to cancel. We will collect the Products from the address to which they were delivered. We will contact you to arrange a suitable time for collection. For Products marked with a blue van icon, the Product must be returned to us via the process detailed in the Returns section.
Because you are a consumer, we are under a legal duty to supply Products that are in conformity with this contract. As a consumer, you have legal rights in relation to Products that are faulty or not as described. These legal rights are not affected by your right of return and refund in this clause 10.17 or anything else in these Terms. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.
Our Products are subject to the delivery charges set out in the delivery calendar on the product page and during the checkout process at the time of your order.
If your Product is available in our warehouse, you will be asked to choose a delivery date when you order. If we need to order your product from the manufacturer or other supplier, we will contact you as soon as possible with an estimated delivery date. Once we have agreed a date for delivery with you, we will confirm this in the Dispatch Confirmation we send to you. For Products marked with a blue van icon, these will be delivered within 7 days of you placing your order. We will send an email to you so that you can track the progress of your order. Occasionally our delivery to you may be affected by an Event Outside Our Control. See clause 18.3 for our responsibilities when this happens.
You own the Products once we have received payment in full, including all applicable delivery charges and the Product has been delivered to you.
If you do not wish to cancel your order straight away, or do not have the right to do so under clause 11.4, you can give us a new deadline for delivery, which must be reasonable, and you can cancel your order if we do not meet the new deadline.
If you do choose to cancel your order for late delivery under clause 11.4 or 11.5, you can do so for just some of the Products or all of them, unless splitting them up would significantly reduce their value. If the Products have been delivered to you, you will have to return them to us or allow us to collect them, and we will pay the costs of this. After you cancel your order we will refund any sums you have paid to us for the cancelled Products and their delivery.
If due to any circumstances beyond our reasonable control we are unable to deliver the Products ordered because to do so would be unsafe or it is not physically possible, for example because the Product is too large to fit through the doorways in your home or the Product is too heavy to be carried upstairs and there is no lift then we will not deliver the Product and we reserve the right to charge you the full cost of delivery. Please see clause 11.7 above for an indication of the full cost of delivery for different items.
This section sets out important information relating to the delivery of certain types of Products. You should read the ‘Delivery and Returns’ page in full. Please also read our ‘Connection and Removal page’ which provides more details on what you need to check before ordering a connection service and what we will and won't do as part of the service. It also explains what we're responsible for.
When purchasing your American Fridge/Freezer please ensure that you have measured the relevant doorways in your home to make sure that the Product will fit through when delivered. We are unable to remove the fridge freezer doors for delivery to take place. If the delivery results in a failure due to this reason the full cost of the distribution will be charged to you, please see clause 11.8 above for further details. If you require any clarification on this please call us on 0333 005 0011. We do not offer a connection service for American Fridge Freezers.
Unfortunately, we do not deliver to addresses outside the UK.
Please note for large items delivery is available to mainland UK and Isle of Wight only (excluding Northern Ireland). For small items we are able to deliver by our courier to mainland UK, Isle of Wight and Northern Ireland.
You may place an order for Products from outside the UK, but this order must be for delivery to an address in the UK.

All prices are inclusive of VAT at the current rate unless otherwise stated.
Please note that delivery charges are not included in the price of our Products stated on our website, unless we expressly tell you otherwise.
Prices quoted are correct at time of entering information. We reserve the right to change prices and specification of any item on our website at our discretion without prior notice or to withdraw any items at any time. We will not be responsible to you or anyone else for withdrawing any items from our website or refusing to process an order. However, this will not affect any orders that have received a Dispatch Confirmation email from us.
Our website contains a large number of Products. It is always possible that, despite our best efforts, some of the Products on our website may be incorrectly priced. If we discover an error in the price of the Products you have ordered we will contact you to inform you of this error and we will give you the option to continue to purchase the Product at the correct price or cancel your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. If the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as being mispriced, then please treat this price with caution and contact us if you have any questions or concerns. By cancelling your order in accordance with this clause 14.5, we will not have to provide the Products to you at the incorrect (lower) price.
You confirm that the credit card or debit card that is being used is yours. All credit card or debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment, we will not be liable for any delay or non-delivery and we are not obliged to inform you of the refusal. Authority for payment must be given at the time of order. Our responsibility to you in connection with any order will not exceed the total price charged for the relevant items.
We are not responsible for your card issuer or bank charging you as a result of our processing of your credit card or debit card payment.
Prices that are reduced for sales and promotions are only valid for the specified period.
All purchases will be limited to 5 Products per customer in any 24 hour period.
Some of the Products we sell to you come with a manufacturer's warranty. For details of the applicable terms and conditions, please refer to the manufacturer's warranty provided with the Products.
The majority of these Products are guaranteed for a minimum of 12 months. In the unlikely event of a fault occurring the following is applicable:
Please note that for Products marked with a blue van icon, we will happily refund or exchange any item that is faulty. However, we are unable to provide a direct exchange and will ask that you return the Product to us for a refund and then re-order the Product from us. Please see our Returns section for further details
Please note all Products are checked for a valid fault. In the event of the reported fault not being found a full refund will not be processed.
Please note that the manufacturer endeavours to offer a free repair service for all Products that develop a fault, not caused by accident, misuse or neglect, within the manufacturer's warranty period. If the Product develops more than three technical faults in the first year of the warranty period an identical or comparable replacement will be offered if requested.
If you are a consumer, a Product warranty is in addition to, and does not affect, your legal rights in relation to Products that are faulty or not as described. You have up to 30 days to reject the Product and receive a full refund if the Product is faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.
We only supply the Products for internal use by your business, and you agree not to use the Product for any resale purposes.
Subject to clause 16.2, our total liability to you in respect of all losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the Products.
Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the Products. Any representation, condition or warranty which might be implied or incorporated into these Terms by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that the Products are suitable for your purposes.
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.
We only supply the Products for domestic and private use. You agree not to use the Product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We will not be responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in clause 18.2.
An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
You may cancel a contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will refund the price you have paid, including any delivery charges.
19.1 If you are a Co-op Member, you may receive offers on selected products from time to time (Member Offers). You must be a Co-op Member prior to making a purchase from Co-op Electrical in order to be eligible. You will need to let us know your membership details at the time of purchase.
19.2 We have two types of Member Offers – those that apply automatically once you sign in to our website with your membership number and others where you will be required to both sign in and apply a discount code at the checkout.
For details of Member Offers that apply automatically please sign in to our website by entering your membership number or call 0333 005 0011. Alternatively write to us at Co-operative Electrical Shop, 6th Floor, 1 Angel Square, Manchester, M60 0AG. These Member Offers will automatically be applied to the price of relevant products once you have signed in to our website. So, the price you’ll see on the product page will be the price with the Member Offer (and any employee discount as explained in clause 19.4 below) already applied.
Sometimes we may provide Co-op Members with a discount code for specific Member Offers that need to be applied at the checkout. Details of these types of Member Offers and the discount code to be used will be provided to Co-op Members in marketing material. For these types of Member Offers, you will not see the final price payable until you have both signed in with your membership number and applied the discount code in the checkout process.
19.3 Member Offers are only available:
19.3.1 for Co-op Members that have a new blue Co-op Membership card with our current logo - you can see examples of how this card looks on our Member Offers page; and
19.3.2 on orders placed over the telephone on 0333 005 0011 or on our website. Member Offers do not apply to products bought in store.
19.4 Member Offers cannot be used in conjunction with any other discount or promotional codes. Where the price of an item has been reduced (for example, where it is in our clearance section), the Member Offer will be applied to the reduced price of eligible items once you have signed in to our website or, where a Member Offer discount code is required, once you have applied the code at the checkout. Employee Members that are eligible for both Member Offers and the employee discount will receive the employee discount off the price of the product after the Member Offer has been applied. .
19.5 Member Offers must be accepted as offered and cannot be transferred sold or exchanged. No cash alternative is available. All Member Offers are subject to availability.
19.6 We may sometimes have to substitute a particular Member Offer for an alternative offer of equal or greater value. There might also be times where we have to change or cancel a Member Offer without notice where circumstances make it necessary to do so.
19.7 We reserve the right to disqualify from Member Offers anyone suspected of fraud, cheating or otherwise acting dishonestly in our opinion.
19.8 Our decision in relation to Member Offers is final in every situation (including any not covered by these terms) and no correspondence will be entered into.
19.9 We are the Promoter of the Member Offers. You can find our details in clause 1 above.
If you find one of our Products being sold for less by one of the Selected Retailers listed in clause 20.8, we will match the lower price charged by that Selected Retailer under our Exclusive Member Price Guarantee.
If you would like to claim the Exclusive Member Price Guarantee at the time before you purchase a Product from Co-op Electrical, you will simply need to contact us by calling 0333 005 0011, to provide us with the name of the Selected Retailer, a full description of the Product (including the name, model, and colour), the details of the Selected Retailer's website address and the price of the Product offered by the Selected Retailer. Failure to provide all details or accurate details might invalidate or cause delay to your claim.
If you would like to claim the Exclusive Member Price Guarantee on a Product you have already ordered from us, please contact us on the day of placing your order. You will simply need to contact us by calling 00333 005 0011, to provide us with the name of the Selected Retailer, a full description of the Product (including the name, model, and colour), details of the Selected Retailer's website address, the price of the Product offered by the competitor and the order number we gave you for the item. Failure to provide all details or accurate details might invalidate or cause delay to your claim.
Calls to telephone number 0333 005 0011 (as referred to in clauses 20.2 and 20.3) are free from a BT landline, but call charges from mobile and other call providers may vary; you may want to check this with your service provider.
Please note that all claims for the Exclusive Member Price Guarantee must be made on day of purchasing the Product from us. The Exclusive Member Price Guarantee will not apply to any claims made after the time at which the telephone lines referred to in clauses 20.2 and 20.3 close on the calendar date on which you purchased the Products from us.
Where the Exclusive Member Price Guarantee applies, we will refund the difference between the price of our Products and the lower price offered by the Selected Retailer. Please note that refunds will only be made using the method of payment you used to make the purchase and that this may take up to 14 days.
Our Exclusive Member Price Guarantee promise is for personal non-commercial use only. We reserve the right to restrict our Exclusive Member Price Guarantee on each item to one item per customer.

Items sold as part of a multi-buy, link or bundle deal from Co-op Electrical will be matched to the cheapest price of each item when sold individually and must also be sold as part of a multi-buy, link or bundle deal from the Selected Retailers for the Exclusive Member Price Guarantee to apply. Our decision on this is final. The price of the item must be publically advertised online and cannot include any membership or personal discounts, except if you are an employee member of the Co-operative Group Limited (525R), in which case we will match the price using the price you have paid at Co-op Electrical after using your employee member discount when you purchased the item.
Our Exclusive Member Price Guarantee is limited to members of Co-operative Group Limited only, excluding electrical items sold through The Co-op Food (the trading name of Co-operative Group Food Limited (26715R). Any purchase of electrical goods made on the Co-op Electrical website or from us over the telephone is subject to these terms and conditions.
We reserve the right to withdraw this Exclusive Member Price Guarantee at any time provided that any claim for a price match that has already been communicated by us will still be honoured.

You may only transfer your rights or your obligations under these Terms to another person if we agree in writing. However if you are a consumer and you have purchased a Product as a gift, you may transfer the benefit of the manufacturer warranty in clause 15 to the recipient of the gift without needing to ask our consent.
This contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise. However, if you are a consumer, the recipient of your gift of a Product will have the benefit of the manufacturer warranty at clause 15 but we and you will not need their consent to cancel or make any changes to these Terms.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
If you are a consumer, please note that these Terms are governed by English law. This means a contract for the purchase of Products from us and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
If you are a business, a contract and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
If you are a business, we both irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with a contract or its subject matter or formation (including non-contractual disputes or claims).
