Terms and Conditions

These Terms & Conditions (including the Privacy, Security and Cookies Policy below) (Terms), along with our Privacy, Security and Cookies Policy (found within our Privacy Policy), provide information about us and the legal terms and conditions on which we sell any of the Products (Products) listed on the Co-op Electrical website (our website) to you.

These Terms will apply to any contract between us for the sale of Products to you. Please read these Terms carefully and make sure that you understand them, before making any orders. If you refuse to accept these Terms, you will not be able to order any Products from us. These Terms, and any contract between us, are only in the English language.

You should print a copy of these Terms or save them to your computer for future reference.

These terms may be amended from time to time as set out in clause 9 below. Please check these Terms to ensure you understand the rights and obligations that will apply each time you wish to order Products. These Terms were most recently updated on 9 November 2016.

Information about us

We operate the Co-op Electrical website . We are Co-operatives E-Store Limited, trading as Co-op Electrical, a registered society registered in England and Wales under the Co-operative and Community Benefit Societies Act 2014 with registered number 29166R and with our registered office at 1 Angel Square, Manchester, M60 0AG. Our VAT number is GB403314604. We are part of the Co-operative Group Limited.

Contacting us if you are a consumer:
  1. General

    If you wish to contact us for any reason, including because you have any complaints, you may call, email and/or write to our customer service team in accordance with our ‘Contact Us’ page. If your complaint is in relation to Products purchased online you can access the Online Dispute Resolution Platform (ODR platform). Further details on the ODR service and access to the ODR platform can be found on their website www.ec.europa.eu/odr.

  2. Cancellation

    To cancel a contract in accordance with your legal right to do so please see the information in clause 10 below in relation to the options available to you.

  3. Contacting You

    If we need to contact you, or give you notice in writing, we will do so by telephone, email or by pre-paid post to the address you provide to us in your order. If you are emailing us or writing to us please include details of your order to help us to identify it. If you send us your cancellation notice by email or by post, then your cancellation is effective from the date you send us the email or post the letter to us.

Contacting us if you are a business customer

You may contact us by telephoning our customer service team by telephone or email as set out on our Contact Us page. If you wish to give us formal notice of any matter in accordance with these Terms, please see clause 1.2(a).s

How we use your personal information

We only use your personal information in accordance with our Privacy, Security and Cookies Policy. Please take the time to read our Privacy, Security and Cookies Policy as it includes important terms which apply to you.

Our Products

The images of the Products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products. As a consequence, your Products may vary slightly from those images.

The packaging of the Products may vary from that shown on images on our website.

Use of our website

Your use of our website is governed by these terms and conditions and our Website Terms of Use. Please take the time to read these, as they include important terms which apply to you.

You may only use our website in accordance with these Terms and our Website Terms of Use and only for lawful purposes and in a lawful manner. All information which you provide to us must be true, accurate, current and complete in all respects. You will notify us as soon as possible of any changes to such information.

Our website is provided to you on an "as is" and "as available" basis without any confirmation being given in relation to our website including (but not limited to) implied confirmations of non-infringement, compatibility, security, accuracy or any implied confirmation arising from course of dealing or usage or trade.

We make no confirmation that our website will meet your requirements or will be uninterrupted, timely, or error-free, that defects will be corrected or that the site or the server(s) that makes it available are free of viruses or bugs.

We will not be responsible to you for any loss of material uploaded or transmitted through our website.

If you are a consumer

This clause 5 only applies if you are a consumer.

If you are a consumer, you may only purchase Products from us if you are at least 18 years old.

If it is found that you are not legally entitled to order certain goods, we reserve the right to cancel your order and will not be obliged to complete the order. We also reserve the right to cancel your account facilities immediately. If we cancel your account or your order, we will immediately refund you any money that you have paid in respect of goods that we will not deliver to you, unless there is any legal reason why this is not possible, e.g. attempted fraud.

If you are a business customer

This clause 6 only applies if you are a business customer.

If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you purchase Products from us.

These Terms constitute the entire agreement between you and us and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.

You acknowledge that in entering into this contract you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms.

You and we agree that neither of us shall have any claim for innocent or negligent misrepresentation based on any statement in this contract.

Placing an Order

You can place an order with us either:
  1. on our website; or
  2. over the telephone by contacting our customer services team as set out on our Contact Us page.

When you order on our website, please take the time to read and check your order at each page of the order process. Our website order process allows you to check and amend any errors before submitting your order to us.

Order process

Please ensure that you read these terms and conditions before placing any orders with Co-op Electrical.

When you place an order with us, you can let us know the following information:
  1. DELIVERY ADDRESS: You will be asked to tell us who you would like the order delivering to and the delivery address. You can also inform us of things which would help us make your delivery, such as "Delivery to first floor flat or above, no lift available."
  2. DELVERY DATE: If your Product is in stock at our warehouse you will be asked to choose a delivery date. If your Product is not in stock at our warehouse we will contact you separately to arrange a delivery date.
  3. PROMOTIONAL CODES: You may be able to apply a Co-op Electrical promotion code to your order (please see separate promotion terms and conditions). Please note only one code can be used during any one purchase. All offers are subject to availability. Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price.
  4. ADD-ONS: You can choose to add extended warranty for your purchase, connection of a Product or removal of your old appliance (where available).
  5. MEMBERSHIP DETAILS: If you are a Co-op member please make sure you provide your Membership Number when ordering so that you can earn or spend any available rewards. Please see clause 19 for further information on Co-op membership.
  6. PAYMENT DETAILS: You can select to pay by Credit/Debit Card. You will be asked to provide your billing address and debit/credit card details. The billing address must be the address your credit/debit card is registered to. If you order on our website, you can also choose to pay by PayPal and will be taken to the PayPal site to complete the payment.

After you have provided your payment details, you will be asked to confirm your order. ONCE YOU HAVE PROVIDED PAYMENT DETAILS, DO NOT PROCEED WITH YOUR ORDER IF YOU DO NOT WISH TO BE BOUND TO PAY FOR THE GOODS. PAYMENT WILL BE TAKEN WHEN YOU ORDER.

After you place an order either on the website or over the telephone, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place as described in clause 8.5.

We will confirm our acceptance to you by sending you an e-mail that confirms that the Products have been dispatched (Dispatch Confirmation). The contract between us will only be formed when we send you the Dispatch Confirmation.

If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our website as referred to in clause 14.5, we will inform you of this by e-mail or telephone as soon as possible and we will not process your order. You will then have the option either to wait until the item is available or to cancel your order in accordance with our Cancellation and Returns policies (as set out below). A comparable Product may be substituted in the event of a Product being unavailable, subject to us first obtaining your agreement.

Any Products on the same order, which we have not confirmed in our Dispatch Confirmation e-mail, do not form part of that contract.

For your protection, a contract will not be made if there is any legal reason why this is not possible e.g. attempted fraud, minimum age etc. Also, for your further protection, the information you provide will be subject to identity and fraud prevention checks.

We store the contents of contracts and will send you the details of your order as well as a copy of these Terms via e-mail.

Our right to vary these Terms

Every time you order Products from us the Terms on our website, being those in force at the time of your order, will apply to the contract between you and us.

We may amend these Terms from time to time for the reasons set out in clause 9.4. Please look at the top of this page to see when these Terms were last updated. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time. Your continued use of our website following any change shall be deemed to be your acceptance of such change. If you do not agree with any change to the Terms you must immediately stop using our website.

If we need to revise these Terms in relation to how they apply to your order, we will contact you as soon as possible to give you advance notice of the changes and give you the option to cancel the order if you are not happy with the changes. You may cancel either in respect of all the Products affected by this changes or just the Products you have yet to receive. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will arrange a full refund of the price you have paid, including any delivery charges.

We will only make changes to these Terms if any of the following reasons applies:
  1. the change is favourable to you;
  2. the change would make the Terms easier to understand or fairer to you, or we are correcting a mistake in the printed or electronic versions of these Terms (provided it is reasonable for use to do so);
  3. we need to make a change to reflect a change in law, regulation, or industry codes of practice (including where we have good reason to expect a change), or a decision by a court, regulator or ombudsman; or
  4. to explain any restriction which might apply in relation to the delivery or availability of any Product or Connection Service.

Cancellation – your consumer right of return and refund

This clause 10 only applies if you are a consumer.

If you are a consumer, you have a legal right to cancel a contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the period set out below in clause 10.3. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the contract and receive a refund (or an exchange), even if you have opened the goods to inspect them, as long as you have taken reasonable care of the goods. Advice about your legal right to cancel the contract is available from your local Citizens' Advice Bureau or Trading Standards office.

However, this cancellation right does not apply in the case of:
  1. gaming or computer software purchased with a tamper-proof seal, where such tamper-proof seal is broken; and
  2. goods where data or software can be loaded on to them (e.g. laptops, digital cameras, etc) where any software has been installed or data has been inputted.

Your legal right to cancel a contract starts from the date of the Dispatch Confirmation (the date on which we e-mail you to confirm our acceptance of your order), which is when the contract between us is formed. Your deadline for cancelling the contract then depends on what you have ordered and how it is delivered, as set out in the table below:

The end date is the end of 14 days after the day on which you receive the Product.

Example: if we provide you with a Dispatch Confirmation on 1 January and you receive the Product on 10 January you may cancel at any time between 1 January and the end of the day on 24 January.

If your contract is for either of the following:

  • one Product which is delivered in instalments on separate days;
  • multiple Products which are delivered on separate days.

The end date is 14 days after the day on which you receive the last instalment of the Product or the last of the separate Products ordered.

Example: if we provide you with a Dispatch Confirmation on 1 January and you receive the first instalment of your Product or the first of your separate Products on 10 January and the last instalment or last separate Product on 15 January you may cancel in respect of all instalments and any or all of the separate Products at any time between 1 January and the end of the day on 29 January.

To cancel a contract, you just need to let us know that you have decided to cancel and contact our customer services team as set out on our Contact Us page and let us know about your decision to cancel the contract.

If you are writing to us (whether by email or post) please include details of your order (including the order reference) to help us to identify it. If you send us your cancellation notice by email or by post, then your cancellation is effective from the date you send us the email or post the letter to us. For example, your notice to cancel will be within the deadline if you have put your letter into the last post on the last day of the cancellation period or email us before midnight on that day (see timescales in clause 10.3 above).

If you cancel your contract we will:
  1. refund you the price you paid for the Products. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount;
  2. refund any delivery costs you have paid, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer (provided that this is a common and generally acceptable method). For example, if we offer delivery of a Product within 3-5 days at one cost but you choose to have the Product delivered within 24 hours at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.
  3. make any refunds due to you as soon as possible and in any event within 14 days after you inform us of your decision to cancel the contract.

If you wish to return the Products to us because they are faulty or mis-described, we will collect them from you at our cost and will refund the price of the Products in full, together with any applicable delivery charges. We will contact you to arrange a suitable time for collection. You have up to 30 days to reject the Product and receive a full refund if the Product is faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

We will refund you using the same method of payment that you used to place your order.

If a Product has already been despatched to you before you decide to cancel your contract then the Product must be made available for collection by us without undue delay and in any event not later than 14 days after the day on which you give us notice to cancel. We will collect the Products from the address to which they were delivered. We will contact you to arrange a suitable time for collection.

All Products are checked on return to our warehouse. In the event of an accessory or free gift being missing, a full refund will not be processed. We will charge you the cost of replacing any missing item(s). Each manufacturer has a different cost per item however as an indication of potential charges please see prices below:
  1. Remote control – approximately £40 including VAT
  2. Instruction book/manual – approximately £10 including VAT
  3. Washing machine pipes – approximately £20 including VAT
Please note that the following collection charges will apply, unless the product is faulty:
  1. Home Laundry & Dishwashing £35
  2. Refrigeration £35
  3. American Refrigeration £55
  4. Cookers £35
  5. Range Cookers £55
  6. Large TV £35
  7. Other Items £10

Because you are a consumer, we are under a legal duty to supply Products that are in conformity with this contract. As a consumer, you have legal rights in relation to Products that are faulty or not as described. These legal rights are not affected by your right of return and refund in this clause 10.17 or anything else in these Terms. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

Delivery Charges and Dates

Our Products are subject to the delivery charges set out in the delivery calendar on the product page and during the checkout process at the time of your order. 

If your Product is available in our warehouse, you will be asked to choose a delivery date when you order. If we need to order your product from the manufacturer, then we will contact you as soon as possible with an estimated delivery date. Once we have agreed a date for delivery with you, we will confirm this in the Dispatch Confirmation we send to you. Occasionally our delivery to you may be affected by an Event Outside Our Control. See clause 18.3 for our responsibilities when this happens.

You own the Products once we have received payment in full, including all applicable delivery charges and the Product has been delivered to you.

If we miss the 30 day delivery deadline for any Products then you may cancel your order straight away if any of the following apply:
  1. we have refused to deliver the Products;
  2. delivery within the delivery deadline was essential (taking into account all the relevant circumstances); or
  3. you told us before we accepted your order that delivery within the delivery deadline was essential.

If you do not wish to cancel your order straight away, or do not have the right to do so under clause 11.4, you can give us a new deadline for delivery, which must be reasonable, and you can cancel your order if we do not meet the new deadline.

If you do choose to cancel your order for late delivery under clause 11.4 or 11.5, you can do so for just some of the Products or all of them, unless splitting them up would significantly reduce their value. If the Products have been delivered to you, you will have to return them to us or allow us to collect them, and we will pay the costs of this. After you cancel your order we will refund any sums you have paid to us for the cancelled Products and their delivery.

Please make sure that you are available on the day arranged for delivery. If no-one is available to accept delivery when the carriers call, we reserve the right to charge you the full cost for a second attempt at delivery. An indication of costs for a second attempt at delivery are as follows:
  1. Home Laundry & Dishwashing £35
  2. Refrigeration £35
  3. American Refrigeration £55
  4. Cookers £35
  5. Range Cookers £55
  6. Large TV £35
  7. Other Items £10

If due to any circumstances beyond our reasonable control we are unable to deliver the Products ordered because to do so would be unsafe or it is not physically possible, for example because the Product is too large to fit through the doorways in your home or the Product is too heavy to be carried upstairs and there is no lift then we will not deliver the Product and we reserve the right to charge you the full cost of delivery. Please see clause 11.7 above for an indication of the full cost of delivery for different items.

Delivery and Connection of Specifc Products

This section sets out important information relating to the delivery of certain types of Products. You should read the ‘Delivery and Returns’ page in full. Please also read our ‘Connection and Removal page’ which provides more details on what you need to check before ordering a connection service and what we will and won't do as part of the service. It also explains what we're responsible for.

Laundry and Dishwashers
  1. The delivery service includes, if requested, unpacking and siting your Product with packaging removed.
  2. If you would like us to take your old appliance away please add this when prompted at the checkout or let us know over the telephone when you order. There is a charge for removal.
  3. Please note laundry products can only be removed if disconnected and free of excess water.
  4. If you would like us to disconnect your old appliance and connect your new appliance, please add this, when prompted, at the checkout or let us know on telephone when you order. There is a charge for this service. Please see 'Connection and Removals' page for full details. Please note that due to stopping restrictions we are unable to offer our Connection Services for London Red Route addresses.
Our responsibility for Home Laundry Connections
  1. After 24 hrs we will not be responsible for any leaks to the pipes.
  2. If you ask us to install with existing pipes the seal may be worn. New machines come with a 1M water pipe; we will not be responsible if you ask us to connect to an existing 2M length.
  3. We are not responsible for anything that is left in the old machine once it is collected.
  4. We are not responsible for surges in power to appliances or any other related electrical problems.
  5. We are not responsible if the appliance has been moved after the connection has taken place.
  6. Please note: we do not offer a connection service for Tumble Dryers.
Fridges, Freezers and Fridge/Freezers
  1. The delivery service includes, if requested, unpacking and siting your Product with packaging removed.
  2. If you would like us to take your old refrigeration appliance away please add this, when prompted at the checkout, or let us know over the telephone when you order. There is a charge for removal. Please note refrigeration Products can only be removed if disconnected, defrosted and free of excess water. We do not offer a connection service for refrigeration appliances.
American Fridge Freezers

When purchasing your American Fridge/Freezer please ensure that you have measured the relevant doorways in your home to make sure that the Product will fit through when delivered. We are unable to remove the fridge freezer doors for delivery to take place. If the delivery results in a failure due to this reason the full cost of the distribution will be charged to you, please see clause 11.8 above for further details. If you require any clarification on this please call us on 0333 005 0011. We do not offer a connection service for American Fridge Freezers.

Cookers/Range Cookers
  1. The delivery service includes, if requested, unpacking and siting your Product with packaging removed. If you would like us to take your old appliance away please add this, when prompted, at the checkout or let us know when you order over the telephone. There is a charge for removal. Please note cookers can only be removed if disconnected and externally clean.
  2. We do not offer a connection service for cooking appliances.
Built in Appliances
  1. Delivery includes, if requested, unpacking and siting your Product with packaging removed.
  2. If you would like us to take your old built-in appliance away please add this, when prompted at the checkout or let us know when you order over the telephone. There is a charge for removal.
  3. Please note we can only remove your old built in appliances if they have been removed from their housing units. We do not offer a connection service on Built-in Appliances.
Damaged on Delivery – Major Kitchen appliances
  1. Very rarely do we deliver damaged goods – however due to the nature of large kitchen appliances sometimes white boxes do get damaged.  Please ensure you inspect your Product while the delivery driver is in your home, this makes the necessary action on this Product a lot easier for you.  If you are not ready to unpack your Product at the time of delivery we strongly recommend that your Product is unpacked, inspected then re-packed.
  2. Our delivery teams are instructed to unpack your Product and should offer to do so without you needing to ask. If they should forget please feel free to remind them.  Please note you must inform us of any damage within 7 days of delivery, any damage reported after this date will not be accepted. The unpacking service is only available for items delivered by Co-op delivery
  3. If you require your old appliance removing please make sure that cookers, dishwashers and washing machines etc, are disconnected, free of excess water and externally clean.
  4. On delivery of your Product please inspect it for damage and notify Co-op Electrical within 7 days of delivery.

No international delivery

Unfortunately, we do not deliver to addresses outside the UK.

Please note for large items delivery is available to mainland UK and Isle of Wight only (excluding Northern Ireland). For small items we are able to deliver by our courier to mainland UK, Isle of Wight and Northern Ireland.

You may place an order for Products from outside the UK, but this order must be for delivery to an address in the UK.

Prices and Payment

Payment can be made on our website by Paypal, American Express, MasterCard, Visa credit or debit card or Delta debit card. If however, you would prefer to pay by any other method please contact Co-op Electrical either by telephone on 0333 005 0011, or via email at sales@coop.co.uk

All prices are inclusive of VAT at the current rate unless otherwise stated.

Please note that delivery charges are not included in the price of the Products stated on our website. Please refer to clause 11 for delivery charges and Product-specific information relating to delivery.

Prices quoted are correct at time of entering information. We reserve the right to change prices and specification of any item on our website at our discretion without prior notice or to withdraw any items at any time. We will not be responsible to you or anyone else for withdrawing any items from our website or refusing to process an order. However, this will not affect any orders that have received a Dispatch Confirmation email from us.

Our website contains a large number of Products. It is always possible that, despite our best efforts, some of the Products on our website may be incorrectly priced. If we discover an error in the price of the Products you have ordered we will contact you to inform you of this error and we will give you the option to continue to purchase the Product at the correct price or cancel your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. If the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as being mispriced, then please treat this price with caution and contact us if you have any questions or concerns. By cancelling your order in accordance with this clause 14.5, we will not have to provide the Products to you at the incorrect (lower) price.

You confirm that the credit card or debit card that is being used is yours. All credit card or debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment, we will not be liable for any delay or non-delivery and we are not obliged to inform you of the refusal. Authority for payment must be given at the time of order. Our responsibility to you in connection with any order will not exceed the total price charged for the relevant items.

We are not responsible for your card issuer or bank charging you as a result of our processing of your credit card or debit card payment.

Prices that are reduced for sales and promotions are only valid for the specified period.

All purchases will be limited to 5 Products per customer in any 24 hour period.

Manufacturer's warranties

Some of the Products we sell to you come with a manufacturer's warranty. For details of the applicable terms and conditions, please refer to the manufacturer's warranty provided with the Products.

Kitchen Appliances, Plasma TV, LCD TV, LED TV, standard TV, Audio, Floor Care and Microwaves.

The majority of these Products are guaranteed for a minimum of 12 months.  In the unlikely event of a fault occurring the following is applicable:

    to 30 days – Engineers visit to determine the fault.  Refund or exchange will be offered dependant upon engineers report. If a removable part is delivered damaged or missing, we will offer to replace the part and you can either take this option or exercise your statutory right to reject the Product and receive a full refund.  30 days your statutory rights will apply.
Small appliances – kettles, toasters and irons
  1. 1 to 30 days – refund or exchange.
  2. 31 days to 12 months – Product exchange.

Please note all Products are checked for a valid fault.  In the event of the reported fault not being found a full refund will not be processed.

Please note that the manufacturer endeavours to offer a free repair service for all Products that develop a fault, not caused by accident, misuse or neglect, within the manufacturer's warranty period. If the Product develops more than three technical faults in the first year of the warranty period an identical or comparable replacement will be offered if requested.

If you are a consumer, a Product warranty is in addition to, and does not affect, your legal rights in relation to Products that are faulty or not as described. You have up to 30 days to reject the Product and receive a full refund if the Product is faulty or not as described. Our liability if you are a business customer

This clause 16 only applies if you are a business customer.

We only supply the Products for internal use by your business, and you agree not to use the Product for any resale purposes.

Nothing in these Terms limits or excludes our liability for:
  1. death or personal injury caused by our negligence;
  2. fraud or fraudulent misrepresentation; or
  3. defective Products under the Consumer Protection Act 1987.
Subject to clause 16.2, we will under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
  1. any loss of profits, sales, business, or revenue;
  2. loss or corruption of data, information or software;
  3. loss of business opportunity;
  4. loss of anticipated savings;
  5. loss of goodwill; or
  6. any indirect or consequential loss.

Subject to clause 16.2, our total liability to you in respect of all losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the Products.

Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the Products. Any representation, condition or warranty which might be implied or incorporated into these Terms by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that the Products are suitable for your purposes.

Our responsibility if you are a consumer

This clause 17 only applies if you are a consumer

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.

We only supply the Products for domestic and private use. You agree not to use the Product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not in any way exclude or limit our responsibility for:
  1. death or personal injury caused by our negligence;
  2. fraud or fraudulent misrepresentation;
  3. any breach of the terms implied by section 17 of the Consumer Rights Act 2015 (title and quiet possession);
  4. any breach of the terms implied by section 9,10,11,13 and 14 of the Consumer Rights Act 2015 (description, satisfactory quality, fitness for purpose and samples); and
  5. defective Products under the Consumer Protection Act 1987.

Events outside our control

We will not be responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in clause 18.2.

An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

If an Event Outside Our Control takes place that affects the performance of our obligations under a contract:
  1. we will contact you as soon as reasonably possible to notify you; and
  2. our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

You may cancel a contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will refund the price you have paid, including any delivery charges.

Co-op Group Member Offers

19.1 If you are a Co-op Member, you may receive offers on selected products from time to time (Member Offers). You must be a Co-op Member prior to making a purchase from Co-op Electrical in order to be eligible. You will need to let us know your membership details at the time of purchase.

19.2 We have two types of Member Offers – those that apply automatically once you sign in to our website with your membership number and others where you will be required to both sign in and apply a discount code at the checkout.

For details of Member Offers that apply automatically please sign in to our website by entering your membership number or call 0333 005 0011. Alternatively write to us at Co-operative Electrical Shop, 6th Floor, 1 Angel Square, Manchester, M60 0AG. These Member Offers will automatically be applied to the price of relevant products once you have signed in to our website. So, the price you’ll see on the product page will be the price with the Member Offer (and any employee discount as explained in clause 19.4 below) already applied.

Sometimes we may provide Co-op Members with a discount code for specific Member Offers that need to be applied at the checkout. Details of these types of Member Offers and the discount code to be used will be provided to Co-op Members in marketing material. For these types of Member Offers, you will not see the final price payable until you have both signed in with your membership number and applied the discount code in the checkout process.

19.3 Member Offers are only available:

19.3.1 for Co-op Members that have a new blue Co-op Membership card with our current logo - you can see examples of how this card looks on our Member Offers page; and

19.3.2 on orders placed over the telephone on 0333 005 0011 or on our website. Member Offers do not apply to products bought in store.

19.4 Member Offers cannot be used in conjunction with any other discount or promotional codes. Where the price of an item has been reduced (for example, where it is in our clearance section), the Member Offer will be applied to the reduced price of eligible items once you have signed in to our website or, where a Member Offer discount code is required, once you have applied the code at the checkout. Employee Members that are eligible for both Member Offers and the employee discount will receive the employee discount off the price of the product after the Member Offer has been applied. .

19.5 Member Offers must be accepted as offered and cannot be transferred sold or exchanged. No cash alternative is available. All Member Offers are subject to availability.

19.6 We may sometimes have to substitute a particular Member Offer for an alternative offer of equal or greater value. There might also be times where we have to change or cancel a Member Offer without notice where circumstances make it necessary to do so.

19.7 We reserve the right to disqualify from Member Offers anyone suspected of fraud, cheating or otherwise acting dishonestly in our opinion.

19.8 Our decision in relation to Member Offers is final in every situation (including any not covered by these terms) and no correspondence will be entered into.

19.9 We are the Promoter of the Member Offers. You can find our details in clause 1 above.

Exclusive Member Price Guarantee

If you find one of our Products being sold for less by one of the Selected Retailers listed in clause 20.8, we will match the lower price charged by that Selected Retailer under our Exclusive Member Price Guarantee.

If you would like to claim the Exclusive Member Price Guarantee at the time before you purchase a Product from Co-op Electrical, you will simply need to contact us by calling 0800 280 0111, to provide us with the name of the Selected Retailer, a full description of the Product (including the name, model, and colour), the details of the Selected Retailer's website address and the price of the Product offered by the Selected Retailer. Failure to provide all details or accurate details might invalidate or cause delay to your claim.

If you would like to claim the Exclusive Member Price Guarantee on a Product you have already ordered from us, please contact us on the day of placing your order. You will simply need to contact us by calling 0800 2800111, to provide us with the name of the Selected Retailer, a full description of the Product (including the name, model, and colour), details of the Selected Retailer's website address, the price of the Product offered by the competitor and the order number we gave you for the item. Failure to provide all details or accurate details might invalidate or cause delay to your claim.

Calls to telephone number 0800 280 0111 (as referred to in clauses 20.2 and 20.3) are free from a BT landline, but call charges from mobile and other call providers may vary; you may want to check this with your service provider.

Please note that all claims for the Exclusive Member Price Guarantee must be made on day of purchasing the Product from us. The Exclusive Member Price Guarantee will not apply to any claims made after the time at which the telephone lines referred to in clauses 20.2 and 20.3 close on the calendar date on which you purchased the Products from us.

Where the Exclusive Member Price Guarantee applies, we will refund the difference between the price of our Products and the lower price offered by the Selected Retailer. Please note that refunds will only be made using the method of payment you used to make the purchase and that this may take up to 14 days.

Our Exclusive Member Price Guarantee promise is for personal non-commercial use only. We reserve the right to restrict our Exclusive Member Price Guarantee on each item to one item per customer.

We will only price match against online prices offered by
  1. Currys
  2. Argos
  3. AO (Appliances Online)
  4. John Lewis Partnership (being John Lewis) and Very
  5. (each a “Selected Retailer” and together “Selected Retailers”). Please note that we will not price match against any other company, including any subsidiaries of the Selected Retailers, any associated or affiliated companies, partnerships or traders, or any other entity associated with the Selected Retailers, to be determined at our sole discretion.

Please note in respect of our price match guarantee:
  1. we will not price match if the relevant Selected Retailer is in administration or closing down;
  2. the price match only applies if the Selected Retailer matches the following delivery standards:

    1. the price of the item includes any delivery charge payable (and cannot be the price payable if the item is collected from a store of the Selected Retailer or a third party);
    2. the Selected Retailer is able to deliver the item within 48 hours of the item being purchased from the Selected Retailer; and 
    3. the Selected Retailer is able to deliver the item within an allocated time slot of up to a maximum of 4 hours on the day of delivery. For large appliances the time slot must be allocated on the day before delivery; for a small appliances the time slot can be allocated on the day of delivery.
  3. we will only price match against:

    1. current online prices quoted by Selected Retailers on the date of your purchase (and not, for the avoidance of doubt, in respect of any period preceding such date);
    2. new Products offered by Selected Retailers that are identical in size, model, colour and specification, and bear the same Product number, as the Products purchased by you, which are sold directly through one of the Selected Retailers websites in the UK in £GBP;
    3. the item must be in stock at the Selected Retailer at the time you make the purchase at Co-op Electrical and must be in stock at the Selected Retailer on the day you make your claim under the Exclusive Price Guarantee from Co-op Electrical;
    4. the Selected Retailers' price must be publically advertised online; our Exclusive Member Price Guarantee does not apply to prices offered by Selected Retailers in stores, catalogues and any other businesses, private sellers, auction sites or market places. The Selected Retailer's price must be exclusive of any discounts for store card holders, members, vouchers, coupons or promotional codes, special offers, price promotions, multi-party discounts or any 'free' items included as part of any promotional event (including, without limitation, "buy-one-get-one-free" promotions).

The Exclusive Member Price Guarantee does not apply to any warranties or guarantees which may be offered with the item by the Selected Retailers.

Items sold as part of a multi-buy, link or bundle deal from Co-op Electrical will be matched to the cheapest price of each item when sold individually and must also be sold as part of a multi-buy, link or bundle deal from the Selected Retailers for the Exclusive Member Price Guarantee to apply. Our decision on this is final. The price of the item must be publically advertised online and cannot include any membership or personal discounts, except if you are an employee member of the Co-operative Group Limited (525R), in which case we will match the price using the price you have paid at Co-op Electrical after using your employee member discount when you purchased the item.

Our Exclusive Member Price Guarantee is limited to members of Co-operative Group Limited only, excluding electrical items sold through The Co-op Food (the trading name of Co-operative Group Food Limited (26715R). Any purchase of electrical goods made on the Co-op Electrical website or from us over the telephone is subject to these terms and conditions.

We reserve the right to withdraw this Exclusive Member Price Guarantee at any time provided that any claim for a price match that has already been communicated by us will still be honoured.

Permission is granted to users of our website to electronically copy and to print in hard copy portions of our website for the sole purpose of using our website as a shopping resource. Any other use or copying of the material on our website is strictly prohibited.

Products and company names mentioned may be the trademarks or registered trade marks of their respective owners. No permission is granted in the respect of use of any of the above; such use may constitute an infringement of the holders rights.

You must not use our website or the server on which they are located for any unlawful purpose including, without limitation, spamming activity, defamatory statements, use of pornography or the infringement of intellectual property or other third party rights carried out by you for which you are responsible.

Communications between us

When we refer, in these Terms, to "in writing", this will include e-mail.

If you are a consumer, you may contact us as described in clause 1.2(a).

If you are a business:
  1. Any notice or other communication given by you to us, or by us to you, under or in connection with the contract shall be in writing and shall be delivered personally, sent by pre-paid first class post or other next working day delivery service or e-mail.
  2. A notice or other communication shall be deemed to have been received: if delivered personally, when left at our registered office; if sent by pre-paid first class post or other next working day delivery service, at 9.00 am on the second business day after posting or if sent by e-mail, one business day after transmission.
  3. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.
  4. The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action.

Other important terms and conditions

We may transfer our rights and obligations under a contract to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you by posting on this webpage if this happens.

You may only transfer your rights or your obligations under these Terms to another person if we agree in writing. However if you are a consumer and you have purchased a Product as a gift, you may transfer the benefit of the manufacturer warranty in clause 15 to the recipient of the gift without needing to ask our consent.

This contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise. However, if you are a consumer, the recipient of your gift of a Product will have the benefit of the manufacturer warranty at clause 15 but we and you will not need their consent to cancel or make any changes to these Terms.

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

If you are a consumer, please note that these Terms are governed by English law. This means a contract for the purchase of Products from us and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, a contract and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

If you are a business, we both irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with a contract or its subject matter or formation (including non-contractual disputes or claims).
